6. Subscriber Responsibilities. The subscriber is fully responsible for the confidentiality of his password and account ID. The subscriber is responsible at all times and responsible for any transaction or activity that takes place on his account. The subscriber must notify us immediately of any unauthorized use of their account or any other breach of security. You are solely responsible for the forms, including, but not limited to, the accuracy and suitability of the contents they contain, as well as the final tables and the application of the information provided by users on the forms. You are also responsible for the security of all personal data derived from the form(s) and communicated to you by FormAssembly. You may be legally liable for copyright or other proprietary rights violations caused or caused by failure to comply with the terms of this Agreement. FormAssembly`s security measures for the protection of user data include at least:i. limiting access to user data to authorized persons;ii.

securing commercial facilities, data centres, IT systems and equipment, including, but not limited to, all mobile devices and other information storage devices;iii. implementation of network, device application, database, and platform security;iv. Storage and disposal of information;v. Implement authentication and access controls within applications, operating systems, and devices;vi. Encryption of user data stored on mobile media; Vii. Encryption of user data transmitted over public or wireless networks;viii. separating user data from information from FormAssembly or its other customers, so that user data is not mixed with other types of information;ix. implementation of appropriate personnel security and integrity procedures and practices, including, but not limited to, conducting substantive checks in accordance with applicable legislation;x.B the implementation of appropriate data protection and information security training for FormAssembly personnel, at least once a year,xi. an information security program with a designated information security officer;xii. review and maintain existing guidelines, procedures and standards at least once a year. 2. The content, organization, graphics, design and other matters related to the Service are the property of FormAssembly and are protected in accordance with applicable copyrights, trademarks and other proprietary rights (including, but not limited to, intellectual property rights). They are only permitted for the use of our content, as expressly stated herein. They do not acquire ownership rights in the content, documents or other materials accessed, created or downloaded through the service, with the exception of the user`s information or data. Our posting of information or materials on the Service does not constitute a waiver of any rights in such information and materials. We will exempt, compensate, defend and defend all liabilities, losses, claims, damages and expenses, including reasonable attorneys` fees, arising out of allegations that the Service infringes the intellectual property rights of third parties, provided that you immediately notify us in writing of such claims; (b) give us exclusive control over the defense and settlement of any such claim; and (c) to provide us with adequate information support in the defense of any such claim. If it is found that the Service is being violated or FormAssembly believes that the Service is likely to infringe the intellectual property rights of a third party, we may, at our discretion and at its own expense, either: (a) guarantee the Subscriber`s right to continue using the Hurtful Service; (b) replace or modify the service that violates the law so as not to render it injure, provided that the service essentially has similar functions; or (c) terminate the licenses for the in-breach service modules that are granted under this Directive. . .
